Profile

Pakco is a practicing barrister who acts as advocate and adviser in disputes before courts and arbitral tribunals. He has particular experience in cases involving construction and arbitration. He acts for both main contractor and sub-contractor. He also has experience in general commercial and contractual disputes, winding-up proceedings, tenancy dispute, probate and trust matters, and passing-off cases. He has appeared as an advocate in District Court, High Court, and in confidential commercial arbitrations.  He is capable of making submissions in Chinese and English. He has experience in applications for and against interlocutory injunctions, striking out for want of prosecution and res judicata and other pre-emptive remedies.

 

Pakco started his practice at the Bar after completing his marshalling with Mr. Robert S. K. Lee S.C., and pupillage with Mr. Erik Shum, Mr. Yeung Ming Tai, Mr. Alan Kwong and Mr. Phil Chau.  He accepts instructions in all areas of civil and criminal work.

 

Civil Case:

 

Construction Arbitration I

He acted as led junior for sub-contractor claiming against the main contractor. The dispute includes the wrongfulness of repudiation of sub-contract, delay, defects and quantum. The claim amount of the arbitration is about HK$100 million.

 

Construction Arbitration II

He acted as led junior for sub-contractor claiming against the main contractor. The dispute includes the wrongfulness of repudiation of sub-contract, delay, defects and quantum. The claim amount of the arbitration is about HK$45 million.

 

Construction Arbitration III

He acted as sole advocate to oppose a dismissal application for want of prosecution and application for peremptory order under sections 53 and 59 of Arbitration Ordinance.

 

Construction Arbitration IV

He acted as sole advocate for sub-contractor claiming against the main contractor. The claim amount of the arbitration is about HK$1 million.

 

Commercial Arbitration 

He acted as co-counsel for Respondent to in a dispute in the sum of US$15 million.

 

HCCT Cases:

He acted as led junior in numerous HCCT cases for both main contractor and sub-contractor.

 

Domestic and Cohabitation Relationships Violence

He acted as sole advocate for applicant in applying molestation orders.

 

Tenancy Dispute

He acted as sole advocate for applicant to strike out the Defence on the ground of res judicata/ Henderson v Henderson abuse. 

 

Land Compensation

He acted as sole advocate for applicant in contested Modified Letter B application against Lands Department.

 

Criminal Case:

 

Obtaining Property by Deception

He acted for accused which involved property of HK$10 million.

 

Trafficking in Dangerous Drugs

He acted as co-counsel for the accused in an on-going jury trial.

 

Warrant Application

He acted as sole advocate in opposing Housing Department’s application for warrant under section 22 of the Building Ordinance.
